EMILY FALLON COACHING – COACHING AGREEMENT (1:1 AND GROUP SERVICES)

Welcome – I look forward to working with you.

Coaching can be a powerful and transformative process. This Agreement sets out how we will work together and what you can expect from me, and what I expect from you.

1. Parties

This Agreement is made between Emily Fallon Coaching Limited (“Coach”) and the individual purchasing coaching services (“Client”).

2. Coaching Services

The Coach provides private 1:1 coaching and group coaching sessions (“Services”), delivered online via Zoom (or similar platform).

Services may include:

  • 1:1 coaching sessions (30 or 60 minutes)
  • Group coaching calls
  • Email or WhatsApp support (where applicable)

Coaching is a collaborative, forward-focused process designed to support the Client’s personal and/or professional development.

3. Term

This Agreement begins on the date of purchase and continues until:

  • All sessions are used, or
  • The agreed programme duration ends

Unless otherwise stated, sessions must be used within 12 months of purchase. Unused sessions after this period are forfeited.

4. Scheduling and Attendance

1:1 Sessions

  • Sessions are scheduled in advance by mutual agreement
  • A minimum of 24 hours’ notice is required to reschedule
  • Missed sessions without notice are forfeited

Group Sessions

  • Group sessions are scheduled at set times
  • Missed group sessions cannot be rescheduled or refunded

The Client agrees to attend sessions on time and in a suitable, distraction-free environment.

5. Fees and Payment

The Client agrees to pay the agreed fee for the Services.

Payment terms:

  • Payment plans (if applicable) must be completed in full
  • The Client is responsible for full payment regardless of usage

Refund Policy

  • Refunds are available within 14 days of purchase (unless services have already been substantially delivered)
  • After 14 days, all payments are non-refundable

6. Group Coaching Terms

Where the Client participates in group coaching:

  • The Coach cannot guarantee confidentiality of other participants
  • The Client agrees to respect the privacy and confidentiality of others
  • The Client agrees not to share or disclose information shared within the group

The Coach is not responsible for any disclosures made by participants.

7. Code of Conduct

The Client agrees to:

  • Behave respectfully towards the Coach and other participants
  • Not engage in disruptive, abusive, or inappropriate behaviour

The Coach reserves the right to remove the Client from sessions or terminate this Agreement without refund if behaviour is deemed inappropriate.

8. Communication and Support

Between sessions, the Client may contact the Coach via email or WhatsApp (where included).

Response times are typically within 1–2 working days.

9. Technology

Sessions are delivered online. The Client is responsible for:

  • Having a stable internet connection
  • Access to Zoom or relevant software

The Coach is not liable for technical issues beyond their control, but will make reasonable efforts to reschedule where appropriate.

10. Confidentiality

The Coach agrees to keep all Client information confidential, except where:

  • Disclosure is required by law
  • There is risk of harm to the Client or others

The Client understands that coaching is not a legally privileged relationship (unlike therapy or legal services).

11. Data Protection

The Coach will process personal data in accordance with UK data protection laws.

Client information will only be used for delivering coaching services and will not be shared without consent, unless required by law.

12. Disclaimer

The Client understands that:

  • Coaching is not therapy, counselling, or medical advice
  • The Coach does not diagnose or treat mental health conditions
  • The Client is responsible for their own decisions, actions, and results

If needed, the Client should seek appropriate professional support (e.g. medical, legal, or psychological).

13. Liability

The Coach makes no guarantees regarding outcomes.

To the fullest extent permitted by law:

  • The Coach shall not be liable for indirect or consequential loss
  • The Coach’s total liability is limited to the amount paid by the Client

Nothing in this Agreement limits liability where it would be unlawful to do so.

14. Intellectual Property

All materials provided by the Coach are for personal use only.

The Client may not:

  • Share, reproduce, or distribute materials
  • Use materials for commercial purposes

15. Recordings

Group sessions may be recorded by the Coach for replay purposes.

By participating, the Client consents to recording.

The Client may not record group sessions without prior written permission.

16. Termination

Either party may terminate this Agreement with 7 days’ written notice.

No refunds will be provided for unused sessions outside the refund period.

17. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions.

18. Governing Law

This Agreement is governed by the laws of England and Wales.
